Hi Gurus, in my journey to buy a resale flat, I have encountered a couple of agents who refuse to be upfront about their last best offer. I am not comfortable to offer without knowing this information. Can I check if it is common practice to do so? Also how can one verify any counter offers received by the agent, is it too rude to demand evidence from the agent to screenshot the offer but block out the name? Are agents audited for any representations/misrepresentations?

Hi,

1) You are absolutely right about agents being subject to hefty penalties if they have any misrepresentation behavior.
2) Therefore all agents are very careful in their wording so as not to be accused of such behavior.
3) It is easier to communicate from agent to agent because this is a business-to-business talk. We are more open to discussion between ourselves.
4) The main reason was we will do our homework before viewing any units and understand very well the market trend in each region, estate, area, etc.
5) So we all know what is the possible reasonable offer to any viewed unit.
6) There are instances where the expectation from the seller and the market price are too far apart. We will tend not to place any offer unless the room for negotiation is accepted by both sellers and buyers.
7) Maybe you are not aware that most offers do not place via text, most of them were merely verbal. Thus the agent might not be able to provide any evidence or proof you wished to have.
8) Although the last offer information is important this is not the only way to determine what is a reasonable offer. You could conduct your own research in that block/area to come out with a reasonable offer.

You may also check past transacted prices to evaluate the value of a unit. However, there are also other factors to consider such as condition of the unit, facing, etc.

I believe that my fellow professionals have responded accordingly but I'd just like to add on that I have came across sellers who accepted an offer of lower price as compared to earlier offers over my past 14 years in this business. Putting in an offer based on last best offer is unlikely the best approach when it comes to purchasing a property, as the situation that sellers are in could change over time. They could have decided to purchase another property, fell in love with another property or already purchased another property along the way from last best offer to now, so their motivation to sell can change drastically. In essence, I always advise buyer to put in their best offer they feel is right for the unit, after doing their due diligence instead of trying to put in a lower offer in anticipation of counter offers from sellers before adjusting the offer, because I have seen buyers missed out on units by just couple of hundreds of dollars which is well within their affordability. In addition, I have also seen buyers missed out units due to delay in their decisions and unit was sold in just a matter of minutes earlier than their decision.

Hi,

It is not mandatory to reveal last offers to all Buyers, just like not all Buyers is obliged to make an offer after a viewing. It depends on the Agent's (and sometimes Seller's) decision whether to reveal any offers to prospective Buyers.

Personally, I will find it rude if the Buyer demands me to show proof or evidence on whatever I had conveyed to them. It shows a lack of Trust and when Trust is lacking, I prefer not to deal with such Buyers. I will also advise my Sellers not to deal with such Buyers, as there may be repercussion later on in the deal.

Perhaps you can consider engaging an Agent to act for you in your purchase if you are facing and have trouble handling such objections.
