Hi Gurus, I have a problem to seek your advice. When I put up option money for my HDB flat, my agent told me that the owner has moved out so no need to do up inventory list and whatever remaining will be mine. As only aircon and wardrobes remain, I did not argue about doing an inventory list since these are fittings included in inventory list. Come final inspection, we realised that the aircons are gone. I am super pissed and the other side argued that nothing states that they cannot take the aircon. I told my agent to settle this for me and she tried to tell me that the aircon very bad and just let them take it. Can anyone tell me that if I have a case to go back to the seller on this? I think my agent is quite useless and i may have to settle this myself with the seller.

Hi,

It is essential to do an inventory list to prevent such things from happening.

It is very difficult to argue fittings and fixtures for some of the things, especially aircon which may define as fittings or fixtures.

But all in all, unless this aircon is a new aircon (meaning less than 3 yrs). It is advisable to change including replacing all pipe and electrical wiring.
This is mainly recommended from the view of hygiene.

Just like the recommendation of changing out the toilet bowl as a minimum renovation expected.

Aircon is considered a fixture, and not to be removed by the Seller. You do have the right to ask them to reinstate the air-con back before you proceed for completion. Do not go for the completion until the matter is settled.
