Morning,

If you were to purchase a HDB resale unit with your fiancee, she and her brother must sell away the unit. Your brother-in-law is not allow to purchase the unit, from your fiancee, unless he gets married or converted to SC, 35 years old and above.
Once the unit is sold, you will be able to get 80% loan.
