You may wish to consult HDB on this as what constitutes to service-apartment, whether it is considered residential.

If you're investing in a commercial business, which runs a legitimate commercial service apartment for other tenants (not yourself) as a company, there would be better be grounds for approval.

If you are buying a service apartment that you intend to stay from time to time, and/or you don't have a legitimate business set-up in Malaysia, then it would sound to me like it is more of a residential setup.

As my colleagues mentioned, best to check with HDB and provide them with the full property details, and they will give you the definitive answer.

If you're thinking of investing in commercial property, there are a variety of options in Singapore too that you might consider! Many owners find it to be much safer investments. Happy to share some options with you if you are looking.

As an HDB owner still serving your Minimum Occupation Period (MOP), you are allowed to purchase property overseas, including commercial service apartments in Malaysia. Singapore’s HDB rules don’t restrict buying foreign property during MOP.

However, keep in mind that owning overseas property does not affect your eligibility to keep your HDB flat, but it may have implications for your financial planning and future applications if you intend to buy another HDB or private property here later.
