Hi,

For HDB, once the last surviving party passed on, what will happen to the HDB flat (20 years flat),

(Q1) if there is no will done by the last surviving owner? - Will the HDB be sold and distribute the sale proceed to the remaining children?

(Q2) if there is a will done by the last surviving owner - the asset will distribute according to the Will, so all the children may not an equal share among themselves. is this correct?

Hi Mr. Vince Ng,

There are generally 3 types of ownership for HDB flat due to its eligibility conditions.
a) Joint-Tenancy: most common. All share of deceased party will automatically transfer to the surviving party.
b) Tenancy-In-Common: Will can be set up to divide for all parties in the deed. If there are no will written, it shall be divide according to succession law in Singapore.
c) Sole ownership: Similar to (b) TIC, except it is only one party involved.

Ans to (Q1):
Dependent on the type of ownership. You may check this using MyHDB (https://www.hdb.gov.sg/cs/infoweb/homepage#js-login), login using the right corner "login" to verify, using your singpass.

Ans to (Q2):
Dependent on the type of ownership. Yes, the share shall distributed according to deceased will.
