Hi do I need to engage a lawyer to put in my son name in HDB property when they turn 21 years. As now they are just 8 years old and 2 years old and knowing our age catching up just to prepare for the future.

Hi,

1) Change or adding a name to a property is not just an administration. It is a part sale process.
2) Part sale means you are selling part of the property share to them. Therefore they also will have to pay for the share at the market rate.
3) In this process you not only need to engage a lawyer to perform the task, but your children will also be subject to pay buyer stamp duty to the IRAS.
4) Thus if your concern is to ensure they receive the ownership when you are no longer around, you may prepare a will to distribute your share to them.
5) If this HDB belongs to both of you, then both of you will have to prepare a will separately to ensure the share of the property is distributed to them according to your wish.
6) Especially if the HDB is under Joint tenancy, the survivor party will take over the deceased share automatically even though there is a will. Thus it is essential that the survivor party has a similar will to the deceased.
7) Do note that your children also must meet the HDB policy to take over the HDB flat. They will not be able to take over if they are non-citizens or under 35 yrs old.

As per what Ling has mentioned, it is not so straightforward as to only adding the name in. You will also need to have HDB approve this part sale. Do take note that in the event that when they are looking to settle down with their life partner in future, they may also some inconvenience to purchase a matrimonial home on their own, subject to the regulations by then.
