You can, and you can check with the law firm to do so, although I have no idea why you would like to do this transfer. If your spouse who is a SPR does not own a property in Singapore, he or she will be able to buy another property at only 5% ABSD to maximise the potential portfolio for returns.

Hi,

1) There are mainly 2 types of scenarios under the transfer of property:
(a) Selling: Your spouse may apply for a loan for the share intended to transfer. Subject to the normal buyer stamp duty (BSD). Since your spouse is an SPR, 5% ABSD is applicable if this is the first residential property going to own.
(b) Gift: No need to pay for the share. Subject to the normal BSD & ABSD as selling.

Hi,

If you have inherited the property within the last 3 years, there will be Seller's Stamp Duty payable if you transfer this private property ownership share to your spouse. 1st/2nd/3rd year holding period -> 12%/8%/4% SSD .

The relevant buyer stamp duties and additional buyer stamp duties will also apply. In your spouse case, as she is a SPR, it will be approx 3% BSD + 5% ABSD . Legal fees of approx $6k will also apply as you need 2 law firms to work on the transfer.
