Unfortunately no, to be eligible for resale HDB, you need to form a family nucleus and your spouse name has to be included in the application regardless whether your son's name is included. You may wish to consider decoupling from the current EC ownership so your spouse can purchase private condo under his own name.

Good morning Mdm Yong,

I am afraid that this will not be feasible arrangement as your husband and you will be considered an entity when it comes to the purchase of the resale HDB. The alternative is the transfer (if fully paid) or sell the existing EC to your son after meeting the MOP if he has the necessary capacity to finance the EC and obtain the loan for the takeover. This will allow yourself and your husband to purchase the resale HDB, be it as a sole owner and your husband as an essential occupier or joint owners. As per current regulations, you are unable to decouple the ownership for HDB therefore if there is further plans to further purchase a 3rd property, this will be critical.

You can purchase the HDB with your son but your husband still needs to be included as the occupier for HDB. Omce your HDB has reached it's MOP 5 years later, your husband will then be eligible tonpurchase a private porperty without incurring any ABSD. This is due to HDB regulations prohibiting the spouse of an owner from purchasing a private property withing 5 years MOP period. HI Madam Yong,

Perhaps you can share with me what the purpose of buying a resale HDB with your son when you and your husband have the EC.

To purchase a resale HDB, you need to form a family nucleus which mean must include your husband. He will not be able to purchase any private property during the 5 years.

There are many other options to go about buying properties thus i strongly recommend that we discuss further to determine what is the best option for you.

You could do that, but your husband will need to be the essential occupier of the HDB flat. This means that he will also need to serve the 5-year MOP before he could purchase another residential private property.

Do take note that you will also be required to sell off your current EC latest within 6 months upon your HDB flat purchase.
