Yes, both of you can eligible to buy a resale HDB flat under non- citizen spouse scheme.

And your spouse has to fulfill the following conditions:

1) If you are at least 21 years old

Your spouse must have a Long Term Visit Pass or Work Pass. The pass must have a validity of at least 6 months and it must be valid at the time of submission of resale application.

2) If you are at least 35 years old

Your spouse must have a Visit Pass or Work Pass. The pass may have a validity of less than 6 months, however, it must be valid at the time of submission of resale application.

Evening Mar,

You can purchase HDB resale unit under non-citizen spouse scheme. Depending on your age, your spouse would require either long-term visitor's pass / Visitor pass of at least 6 months validity from point of submission.
