Hi all.

My mum passed away a few years ago and in her Will she listed both my sister and I as the beneficiaries of our current Hdb flat , which she previously co owned with my dad .

My question is , if I’m looking to purchase my private property now . Would there be any repercussions such as ABSD.

Hi Dexin,

Have you or your sister taken ownership of the HDB yet? If so, you would be considered to have 1 property count, and the next property purchase will incur ABSD.

Dear Dexin,

Since you mentioned that it was a few years ago, I am assuming that ownership of the property has already been transferred to your sister and you? Are you still owning this flat now or it has been sold?

ABSD is only applicable if you are an owner of a residential property now, whether as a whole or partial own. If you are a SPR, then it will be applicable as well in the event that you are purchasing your first residential property too.

Hi Dexin,

1) Since you are appointed as the beneficiaries of your current flat, means that you are one of the legal owners of the current flat.
2) In other words, you owned one residential property now.
3) When you buy a private residential property now, it will be counted as the 2nd residential property.
4) So you will be subject to a 17% ABSD on this purchase.

Hi Dexin,

It really depends on what was stated in the Will. Also, if the HDB flat was held under Joint-Tenancy, your Dad, being the sole survivor, will be the sole owner of the flat.

If you are currently an owner of the HDB flat, then yes, you will be liable for ABSD should you purchase a private property.
