My current is situation is quite unique and I would like to seek advices. My aunt deceased on 8 November 2013. In her will, she left her 3 room HDB flat to be shared equally between my older brother and I. Please note that my older brother is a mentally disabled person currently attending MINDS. I am the trustee/executor of my aunt’s will. Currently, my older brother is age 32 and my age is 24. On 22 December 2014, I went down to the HDB branch in Jurong West, and the flat is currently registered under my name and the title deed is safekept by HDB ever since then till now. I have been paying the monthly conservancy fee for this flat from then till now as well.
My enquiries are as follows:
Q1: Am I allowed to hold on to the flat and rent the flat out?
Q2: If the answer to Q1 is ‘No’, can I wait 3 more years for my older brother to turn age 35 and changed the flat to his name so that the flat can be rented out?(Note: My dad is the deputy for my older brother)
