I would like an advice that whether can sell the HDB in the open market rather than surrender to HDB as haven reach the MOP yet? Still waiting the final judgement. Anyone has experience on this?

1. When appealing to sell before your MOP is up, always attach the final judgment for proper review.
2. Applications without meeting MOP will be auto-rejected by the system.
3. Without an approved Intent to Sell, marketing the flat is premature.

Upon final judgement, there will be decision on how the flat can be managed and from there you will have the make the necessary steps to approach HDB for their approval to sell in the open market before MOP. Understand from others that whether can this be sold in open market will very much depend on how far you have completed your MOP journey and Seller's Stamp Duty may also be involved in this process.

1) It depends on the following:
(a) whether this was a BTO bought directly from the HDB or a resale flat.
(b) The period you have hold on to the flat.

2) A resale flat has a higher chance of receiving approval from the HDB to sell.
3) If the MOP is not far from reaching, the chance of a successful appeal also will be higher.
4) Your flat will be under the 3 yrs SSD. You will be subject to SSD if you only owned the flat less than 3 yrs.

For HDB flats, you cannot sell in the open market before the Minimum Occupation Period (MOP) is completed. The only exception is if you meet certain HDB’s early release schemes, which are usually limited to cases like divorce or financial hardship, and even then HDB approval is required. Selling directly to a private buyer before MOP is not allowed.

Since you mentioned your final divorce judgement is still pending, you’ll need to wait for the MOP to be completed before HDB can approve any sale to another party. In the meantime, you can explore options like transferring ownership to the other spouse (if HDB allows) under divorce terms, or consult HDB for early release conditions.
