Hello, what are the options available if my partner has a private property under his name? However, the property was registered by his parents under his name. Does this mean that we are not able to purchase any HDBs/BTOs/ECs without incurring any stamp duties? A private property will be too expensive as we are a young couple.

Dear madam,

I am assuming that you are married or will be getting married soon. As your partner is currently named as an owner of a private residential property. you will be required to sit out for a 30 months period after disposing this property in order to be eligible for BTO or brand new EC, provided you fulfil all other requirements for the purchase. You are still eligible to purchase a resale HDB in this case, but your partner will be required to dispose off the private residential property or relinquish his ownership in this property within 6 months from taking possession of the resale HDB.

Hi

This is a common problem affecting newly wed couples. Firstly, your partner need to either dispose off or transfer the name of the private property back to his parents. Secondly you have to wait for a 30 months period after the private property disposal in order to purchase a BTO or resale with housing grants. If you choose to purchase a resale without housing grant, there is no need for the 30 months buffer period but your partner need to dispose off his private property within 6 months after purchasing a HDB resale. If your partner do agree to dispose off or make a name transfer his private property, you may appeal to HDB to allow you to purchase a BTO or HDB resale with housing grant but nothing is conclusive. Hi Ms,

As your partner currently owns a private property, both of you will not be eligible to apply for a BTO flat, unless he dispose off the property and wait out a period of 30 months. Similar for EC direct from the Developer.

Both of you are free to purchase a HDB resale flat though. Upon the resale flat purchase, he will have to dispose off his interest in the private property within 6 months. You will also not be eligible for CPF Housing Grant. The only Grant you may qualify for would be the Proximity Housing Grant, if you purchase the flat that is within 4km to either of your parents place of residence.

Another option would be a resale EC, from the previous owner whom had served the MOP for the unit. A resale EC is considered as a private property, and there will be no Grants.

However, you will be eligible for resale EC (under just your name) or a resale HDB if your partner is able to sell his private property or transfer to someone else.
