Hi, you can still negotiate with the seller agent about the option fee by not paying again the 1k.

Hi;

Best is to revert back to your agent. The seller has no obligation to refund you back the $1k deposit. And also, you canot use this Valuation Report for your next OTP and you will have to redo the Valuation again.. Furthermore, there is no gurantee that the Valuation will turn out to be the same as the previous Valuation.. So best is to revert back to your agent and let your agent advise you. Hope this helps.. Dear sir/mdm,

In this circumstance, the original Option To Purchase where valuation turned out to be lower than the agreed price will deem to have lapse after 3 weeks from issue, therefore seller has a right to forfeit the $1,000 you have paid to secure the Option To Purchase.

If the negotiation has been done in good faith by the seller where they have agreed to issue a new Option To Purchase at the lower price based on the valuation gotten without additional terms and conditions, I personally feel that it is a bonus for you and you will need to reapply for a fresh valuation request based on the new Option To Purchase.

Otherwise, seller is not wrong to expect another $1,000 to be paid to him for the fresh Option To Purchase to be issued. Hope the above clarifies the situation.
