HDB approved resale in Aug2022, set completion date Sept2022, but emailed 1 day before completion that it was rescheduled due to investigation. HDB subsequently informed in Dec2022 that the resale is cancelled due to: Sellers are not eligible to sell. My CPF OA was deducted in Aug2022 and refunded in Dec2022. The seller should already know that the resale transaction was cancelled by HDB in Dec 2022.

I have reached out to Seller agent since Mar 2023 and seller via a mutual friend, but there has been no reply or effort to call me.

How can I get my deposit of $5K and damages from the seller? Do I file a claim in Small Claims Court? Or do I just get a lawyer? The seller was provided with my phone number via mutual friend, but has not called for over 3 weeks.

Sorry to hear about the situation, from my understanding, you are entitled to take back the $5,000 of option money and exercise fees from the seller without interest since this is a case that is rejected by the HDB. Any additional damages you are seeking out for should be advised by your lawyer. If you are facing issues in getting back this $5,000, the only way to do so is to file Small Claims against the seller. Are you aware of where are they staying now?
