Asked by
first time buyer actually and actively looking for a home.. But today, an agent asked me to sign something after a viewing saying that he introduced the property to me . I didn’t really understand whether this was just a record of the viewing or whether signing it could mean I’m agreeing to pay him commission later.
I asked him and he said it’s standard, but I don’t want to sign documents I don’t understand. Is a viewing acknowledgement normally different from an agreement to appoint an agent?

**A viewing acknowledgement is fundamentally different from an agreement to appoint an agent, and you are completely right to pause and refuse to sign anything you do not understand.**

Many first-time buyers get caught by this. What you need to know about what you were handed and how to protect yourself:

---

### 1. Viewing Form vs. Estate Agency Agreement

* **A True Viewing Acknowledgement / Attendance Slip:** This is simply an internal agency record confirming you physically inspected the unit at a specific date and time. Listing agents sometimes use this to prove to the seller that they brought prospective buyers. It should contain **zero clauses regarding fees, representation, or exclusivity**.
* **An Estate Agency Agreement (CEA Prescribed Form):** Under Council for Estate Agencies (CEA) regulations, formally appointing an agent to represent you requires an official **Estate Agency Agreement for the Purchase of Residential Property** (such as Form 2 or Form 6). This legally binds you to commission terms and scopes of service.

---

### 2. The Trap: The "Effective Cause" / Introduction Clause

Some agents slip in an un-prescribed "Viewing Confirmation Slip" containing fine print stating:

> *"The buyer acknowledges that this salesperson introduced this property. If the buyer subsequently purchases this property through another salesperson or directly, commission of 1% (or 2%) remains payable to this agency."*

**Never sign this.** If you sign a slip containing that clause, the agent can attempt to legally claim that they were the "effective cause of sale." If you later engage your own buyer's agent to negotiate and close the flat, you could be dragged into a commission dispute or pressured to pay fees out of pocket.

---

### 3. What You Should Do Right Now

* **Refuse Politely:** You have **zero legal obligation** under CEA rules to sign any viewing slip to enter or view a home. Say: *"I am an unrepresented direct buyer exploring options. I do not sign viewing forms or appointment agreements."*
* **Ask the Direct Question:** Ask: *"Are you representing the seller or representing me?"* If he represents the seller, he is paid by the seller, not you.
* **If You Already Signed:** Request a photo/copy immediately. If it includes a commission claim, write to the agent via WhatsApp/email stating you were there solely as an unrepresented viewer and revoke any implied appointment.

ANSWERS

✔1. Yes, they are different documents. A viewing acknowledgement usually records that you viewed a property, while an estate agency agreement sets out the agent’s appointment, services and commission terms.you did not understand, DO NOT SIGN ANYHOW

✔2. Read the entire document before signing. Check for clauses about commission, exclusive representation, or fees if you later purchase the property through another agent or directly. The document’s title alone does not determine its legal effect.

✔3. Ask the agent to clarify in writing. Confirm whether the form is only proof of viewing or creates any payment obligation, and request a copy before signing.IF you did not understand, DO NOT SIGN ANYHOW

✔4. Know who the agent represents. If the agent acts for the seller, do not assume you have appointed them to represent you as the buyer. Clarify any proposed commission arrangement before proceeding.

✔5. If you have already signed, obtain a copy and seek clarification before making an offer. If the wording suggests a commission obligation you did not understand, DO NOT SIGN ANYHOW

“Never sign what you don’t understand.”

Hi there!

Firstly, it's good that you're asking questions before signing documents you don't fully understand, especially as a first-time homebuyer.

Let me clarify something important.

**A viewing acknowledgement and an estate agency agreement are not necessarily the same thing.**

A viewing acknowledgement is commonly used to record that an agent introduced or showed you a particular property.

An estate agency agreement, on the other hand, formally establishes the appointment of an agent, including the scope of services and any agreed commission arrangements.

**However, the title of the document alone does not determine your obligations. What matters is what you are actually agreeing to.**

Before signing, I would suggest clarifying three things with the agent:

1. Is this document simply acknowledging that I viewed the property?
2. Does signing it create any obligation to pay commission if I subsequently purchase the property?
3. Am I appointing you to represent me as my buyer's agent, or are you representing the seller?

If the agent is representing the seller, that does not automatically mean you have appointed the same agent to represent you.

There is nothing wrong with an agent requesting documentation for legitimate purposes. However, you should always be given sufficient opportunity to understand what you're signing.

**Since you're actively searching for your first home, may I offer one additional suggestion?**

Consider working with a buyer's agent who can guide you throughout the purchasing process, from establishing your budget and shortlisting suitable properties to assessing asking prices, negotiating offers and understanding the transaction procedures.

A good agent should help you make informed decisions, not leave you feeling pressured or uncertain.

**May I ask whether you're looking to purchase an HDB flat or private property, and which locations you're considering?**

I'd be happy to guide you through the process and assist with your property search.

Best regards,
**Geryl Lim**

This is typical behaviour for many agents who may feel insecure of the value they bring to the client, but it is also a red flag.

For myself, I actually tell my clients they can speak to as many agents as they want, because I'm confident that the other agents will not be able to provide more value than I can provide to the clients.

I'm a Harvard graduated real estate agent with a degree in economics, and have supported clients on more than $1 billion in transactions.

I run in-depth analysis for all my clients on selling and buying. These includes analysis on demand-supply analysis, government transformation plans, exit strategy, rental analysis, location analysis, psf analysis, capital appreciation analysis, layout efficiency etc.

So I never force my clients to sign an exclusive with me throughout the process even while I am showing them various property options because I know it is extremely unlikely they can get better analysis, better service, or better prices elsewhere.

Meanwhile, it sounds like you are actively searching for an agent to support your property plans. I'll be happy to meetup to see if it could be a fit for us to work together without any obligations :)
