Dear Sir/ Madam
I will soon move to Singapore with my wife who is a US National/ US Passport holder. As a married couple would we be eligible to avoid the ABSD of 30% on our first residential property purchase? The home would be our primary/ only residential property in Singapore. Neither of us hold Singapore PR status. My question is really centred around whether we would be eligible for ABSD remission if the non US National would be paying the mortgage - even though we are a married couple.

Hi,

For US nationals, they can purchase residential property without ABSD due to the free trade agreement. So your wife can purchase as a single without ABSD.

However since you are neither Singaporean nor SPR, and only your wife is US national, in this scenario if you choose to do a joint purchase, it is better to write in to IRAS Singapore to get a written confirmation on whether ABSD remission is possible. As this is a unique scenario not under the typical criteria.

Hi,

1) As long as your wife is a citizen of the United State, she is entitled to enjoy the benefit of being a Singapore citizen in a property purchase.
2) Only the normal buyer stamp duty was incurred in the 1st residential property purchase.
3) You must be one of the owners of this purchase in order to get the mortgage.
4) There are 2 types of joint ownerships that you can select from:
(a) Joint-Tenancy (JT): All owners will have equal shares and rights in a property. The right of survivorship applied, means that if one person passes away, the other party automatically assumes full ownership of the property.
(b) Tenancy-In-Common (TIC): The owners can determine how much share each own in a property. The share can be transfer/willed to another person without the consent from the other owners.

Hi Sir,

ABSD remission is only applicable for Singaporean Citizens purchasing their first matrimonial home.

Based on your situation, if you (foreigner) purchases the property jointly with your US Citizen Wife, you will be liable for ABSD of 30% (higher tax rate).

If the property is purchased solely under your Wife's name, she will not be liable to pay ABSD under FTA.
