Hi Leslie,

Resale Levy is only payable if its a 2nd subsidized flat (ie. resale flat with grant) I believe that's not the case for your sis when she takes over, hence there's no need to pay levy.

Hi Mr Leslie,

Basically resale levy is payable only when the buyer purchase a 2nd subsidised flat. So if your sister is buying over your flat then it will not be a subsidised flat. So there is no resale levy involved.

But do help me to advise your sister, if their current house is a subsidised flat, meaning either it is a BTO from HDB or a resale flat from the open market, then when they decide to purchase a BTO in the future, they will be liable to pay a resale levy. Hope that clarifies.

Your sister will not be subject to resale levy as long as she is not purchasing a subsidised flat (HDB and EC directly from HDB).

Yours sister choose to sell off her unit and take over your unit will be considered as a resale transaction. Hence levy is not payable. However, if their current unit have utilized HDB loan and they have intention to take another HDB loan, they will need to prepare 50% of the cash proceed to be transferred into the purchase.

She is not liable for resale levy in this case. However, do take note that if she chooses to undertake another HDB loan for your current 5RM flat, she will need to pay down 50% of her cash proceeds from her sale of her HDB flat towards the new HDB flat.
