Yes there are restrictions. You must have sold you pte property more than 30 months ago before you can apply for a new HDB flat.

For gift cases, you might want to appeal to the HDB. But chances are not definite.

Hi Tminh,

Like what Jonathan had mentioned, there will be restrictions but HDB may consider granting exemption to exceptional cases based on the merits of each case. If you wish to seek exemption to buy a flat direct from HDB, you have to complete the property questionnaire from the link below and submit it to HDB.
