Dear Guru, my wife and I are currently undergoing an uncontested divorce.

We mutually agreed that I could retain the matrimonial HDB Resale 4 room unit.

However, I was only 30 years old as of 7 March 2023, and realised that I was unable to retain the unit under Single Scheme.

I would really want to keep this unit, as it holds many sentimental value to me.

After divorce, will HDB enforce surrender the unit?

I do not have any other place of stay if they evict me. My father place also fully occupied by my other relative.

Is there any advice that you could give me?

You have to be eligible to retain the flat as a sole owner. Being 30 years old without children makes you ineligible to retain the flat.

From the HDB wensite: If you have no children from the marriage, you can retain the flat alone if you are a Singapore Citizen, at least 35 years old, and meet the prevailing conditions for retention of the flat under the SSC scheme.

Alternatively, you can include another person to retain the flat with under an eligibility scheme, subject to you meeting the prevailing conditions.

You can try appealing to HDB before the divorce and if it does not work , try going down to meet the MPs for their help in the appeal. I hope everything works out for you. You can reach out if you have further questions and I will try my best to help.

Hi Atreus,

Sorry to hear about the situation, I hope you are managing well. You will have to qualify under a HDB scheme to be eligible to keep the HDB, typically under the public scheme again with your parents or another co-owner, or if you have custody of your kids. Otherwise, HDB will not permit you to keep the flat and unfortunately it has to be surrendered to HDB or be sold on the open market.

Sorry to hear about your situation. From what you shared, it is not possible to retain the HDB under such a situation. You may want to discuss with your wife to see whether you are able to hold back the divorce until after you turn 35 years old. If not, then it will be better to sell the HDB flat and use the funds to get another property so that you will have a place to stay.
