Dear All,

I would like to know the below,

1) What is the process on HDB flat selling when a person pass away. Last I heard HDB do retain a sum and have to sell the HDB flat to them as the person is no longer around.

2) There is no will from the person.

3) How is the the % split among the living sibling and grand Son?

Hi,

I'm not sure what do you mean by HDB retaining a sum, but if the flat is fully paid there isnt any sum to repay. If there are no loved ones eligible to keep the flat typically it needs to be sold on the open market. An administrator needs to be appointed to manage the property and estate affairs. If theres no will, the estate proceeds will follow the Singapore intestate succession laws. A good illustration can be found at this link.

Good evening,

If the HDB unit owner have passed on without a WILL, the immediate NOK can file for Grant of Probate with court. As for the split, it would depends on how many people are eligible for the share. As for this pointer, it would be based on case by case basis.

Hi,

All HDB flats were bought with HPS (Home Protection Scheme), thus it dependent on the proportion of his loan commitment to determine how much or are there any outstanding loan to HDB or bank.

Lets assusme this flat is fully paid to simplify the situation.

(1) When a person dies:
(a) With a Will: Court will issue a "Grant of Probate" and appoint an Executor to carry out his will.
(b) Without a Will:Court will issue "Letters of Administration" and appoint an Administrator to distribute property to his successor according to Intestate.

Do note that Intestate Succession Act is different for Muslim as Muslim with follow Syariah Law.

(2) Please see 1(b).

(3) Dependent on whether you are Muslim or Non-Muslim:
Non-Muslim follow intestate:
If deceased;
(1) Not married: 100% to parent(s)
(2) No parent: 100% to sibling(s) or children of deceased sibling(s)
(3) No parent or sibling: 100% to Grandparent(s)
(4) No Grandparent: 100% to Uncle(s) & Aunt(s)
(5) No relative: 100% to Government / State
