Good afternoon,

Sorry to hear about the situation, I hope you are managing well. The current regulation is such that for private property owners who just sold their property, if they are 55 years and above, they can purchase 4-room or smaller resale HDB straightaway no issue. However if they are not 55 years old yet, they are required to wait out 15 months before being eligible to purchase the resale HDB. If so, we can do an appeal with HDB to try to get special approval as after all it is due to unforeseen circumstances of divorce.

May I also know if the court order final judgement is already out? As we will be required to follow the treatment of the matrimonial property strictly (be it sale or transfer etc.)

Sorry to hear about the situation. Basically, the regulation now does not allow you to purchase a resale flat now immediately after selling the current EC. You will need to wait out a period of 15 months before you are eligible to do so, unless you are 55 years old or above and looking to purchase a resale 4 room flat or smaller. Of course, you may wish to file an appeal based on your actual situation and see if they allow an exception. Sorry to mention, if the split is amicable and both agree on the arrangements you have mentioned, it could be more straightforward, otherwise it is likely that you will need to see what the court order is on how the current EC should be managed.
