The agent is not supposed to give you advise such as early MOP is possible as this is not in compliance with law and statutory requirements.

Under the Code of Ethics and Professional Client Care which is part of the Estate Agents (Estate Agency Work) Regulations 2010, estate agents and salespersons must conduct their business and work with diligence and care. Therefore, they must not do anything which may, directly or indirectly, lead to the breaking of any law by any person.

They must also not undertake estate agency work in respect of HDB flats unless they are fully conversant with the applicable laws, regulations, rules and procedures that apply to transaction involving such flats.

CEA will investigate the complaint, if lodged by either HDB, seller and buyer or the co-broke salesperson.

On conviction, the seller's agent is liable to disciplinary action, with potential penalties such as fines, warnings, suspensions and revocation of his/her licence.

If you have obtain approval from HDB to sell before fulfilling the MOP, yes, you can. The approval is granted on a case by case basis.

The owners are not suppose to enter into any form of pre-agreement of sale prior to meeting their MOP.

This is not true as you are not allowed to sell the house before the MOP. However, if you have a genuine reason to sell, we can appeal to HDB to get the waiver of the MOP.

You will only be able to sell the HDB flat before its MOP if HDB waives off your MOP and grants you the approval to sell.

If you have a strong reason, you may wish to write in to HDB to request for the waiver. Decision will be on a case-by-case basis.
