Dear sir/mdm,

You cannot simply change ownership of an HDB flat freely.

HDB treats ownership changes very strictly. There are only specific scenarios where owners can do a Change of Ownership (COO), such as:

* Divorce / Separation
* Marriage (adding spouse)
* Death of owner (transfer under inheritance)
* Medical reasons (e.g. owner physically unable to continue ownership)
* Financial hardship (case by case, subject to HDB approval)

In other words, parents cannot just “give” their HDB flat to you because they already got another BTO.

If Your Parents Want to Pass the Flat to You

They typically have two routes:

1. Resale to You

* You must be eligible to own an HDB flat (citizenship, age ≥ 21, family nucleus, etc.).
* They sell you the flat through the HDB resale process.
* You (as the buyer) must pay a fair market value — usually at least 100% of HDB’s assessed market value (not 80%).
* Buyer’s Stamp Duty (BSD) and legal fees apply.
* Any outstanding loan/CPF used by your parents will also need to be settled.

2. Transfer of Flat Ownership (COO)

* Only allowed if you meet HDB’s eligibility conditions.
* For example, if your parents are elderly and applying under the “Parent & Child” scheme, you may apply to take over ownership with HDB’s approval.
* Even then, you cannot simply take over for \$0 — CPF refund rules and stamp duties may still come in. Read More

Its either through Transfer of ownership or Sale at market value to you at market value. Both will require HDB approval before this can be done. You may wish to reach out to HDB branch on the feasibility of either method, and you also have to fulfill HDB eligibility conditions before you can be allowed to own an HDB.

Hi,

1) In Singapore, Property share can only give or transfer via legal:
(a) Transfer of share: Part or whole shares can be transfer to immediate family.
(i) If CPF funds is utilized in the purchasing of the flat. The fund used must be returned to the transferer with accrued interest.
(ii) Buyer Stamp duty: The receiver must pay stamp duty for the value of the share according to market rate.

(b) Gift: The property must be free from outstanding loan. 1(a) (i) & (ii) is applicable.

(c) Part-share purchase: The difference between this and 1(a) is the receiver must pay the transferer (seller) share according to the market value. 1(a)(ii) is applicable.

2) Before you buy, you must ensure you meet one of the HDB eligibility scheme and criteria.
3) You may buy under market value, but stamp duty will be calculated according to the market value. This implied, if the property is valued at $500k. The stamp duty will be
$9.6k. You will have to pay this amount regardless of how much you are paying your parents.
