Can a HDB be rented out by the immediate family member after demise of the HDB owner? The family member is the sole beneficiary and executor of the HDB. As probate process will take a few months, can the flat be rented out in the meantime.

Since probate is not out, then no one is allowed to sign on the tenancy agreement, and upon the probate. Is the sole beneficiary eligible to retain the HDB?

You will not be allowed to rent out the HDB in the interim period. However if the intention is to sell the flat once the grant of probate is done, you may make use of this period to prepare the unit and market the unit for sale.

Unfortunately as the HDB is in the probate process, typically it is not possible to rent out the whole unit as HDB will not grant subletting approval while property is in transmission.

If the intention is to sell the property, you may take this time to prepare the property for sale in the interim. I have helped on similar cases and would be happy to share my best experience.
