Both of I and my wife are Singapore PR (Nationality: China) and going to divorce. We just bought a HDB EM in Jurong West one and half year ago. We will lodge legal case to divorce in China and right now my wife is in China also. How can I do with my HDB flat in Singapore? We have to sell the flat after divorce by appeal to HDB or we can keep it after 3.5 years? How can I do if my wife reject to sign the HDB document> Thanks.

Afternoon, As I'm not well versed with the legal system within China, I can only advise based on Singapore context. All divorce cases are based on different ground and with that, the duration required differ. Whatever the case might be, both partie will be required indicate their standing and intention in court. Once the divorce procedure have being firmed down, you will be required to informs HDB about it which in turn means that you have only 6 months to settle the HDB unit accordingly. If your spouse refuse to sign the OTP, you can appeal to court, with supporting evidence and have the court act accordingly.
