Both my wife and my name are listed as owners on our current EC unit. After MOP, is it possible for either of us to change to occupier so that one of us is able to purchase a 2nd property without ABSD?

Good morning,

Yes sure, this is what is commonly referred to as decoupling, where one of the owners sell their share of ownership to the remaining owner.

Some calculations are involved, meaning the remaining owner needs to be able to finance the property or his/her own (ie bank loan must be approved), must refund the cpf utilized+accrued interest of the outgoing owner, and also pay the relevant Buyer stamp duties and legal fees. The outgoing owner, with no name to property ownership, will be able to buy the next residential property without any ABSD.

Hi,

1) To change the status of the owner to the occupier, is the process of selling one's property share to another.
2) You have to know the current value of your EC.
3) Your current type of ownership, such as Joint-Tenancy (JT) or Tenancy-In-Common (TIC). Joint Tenancy means each of you owns a 50% share in the property. TIC could be of any share.
4) To simplify the explanation, assume yours is JT. So you have to calculate how much the share cost, how much CPF + accrued interest has to return to the intent "occupier" CPF OA.
5) To do a TDSR assessment to determine the remaining owner whether can afford to take up the additional mortgage.
6) Once you have done all this homework, you will know whether you are able to proceed with your plan.
7) You may approach any real estate agent for assistance if you worry your calculation is not accurate.

Hi, yes sure it is possible to do a transfer of share to the other spouse. You just need to consult your law firm for more info like the stamp duty fee, CPF issues and etc.

Yes you can do so. Nevertheless, it is important to exercise financial prudence over this decision, if you are looking to purchase another unit as an investment where you will rent out either property. Yes this is possible and common among private owners. This process is called decoupling and there are some important considerations to take note of before proceeding. Assessment will need to be done to determine who is a better option to exit the current property and take up a new property loan.

Hi Sir,

What you are describing is actually what is commonly known as "decoupling".

In decoupling, one owner relinquish his ownership of the property by selling his shares to the other party, thereby freeing up his name from the property.

Do take note that stamp duties are payable for decoupling too, and it's on the percentage of shares that are being transferred.

As a resale EC that has met the 5-year MOP is considered a semi-private property, very much like a private property, the owner can do a transfer via decoupling to his spouse.
