Both me and my wife have been working and studying overseas for the last 3 years. We intend to return to Singapore after my wife completed her PHD in 2015.

For the past 2 years, HDB has given us approval to sublet the whole flat, but last year. our application to renew was rejected. HDB gave us an ultimatum to either return to Singapore and stay in our property or surrender it to HDB even though we have explained that we will return after my wife has completed her PHD, including supporting documents.

What are our options at this point of time? Can we request to sell the flat in the open market under special circumstances as we have not met the 5 year MOP. Thank you.

Afternoon,

You would have already answered your own question. Since HDB have given you the ultimatum to either return and stay in the unit or surrender it back to HDB, you chances to appeal to sell it within the open market is slim. Given that HDB have quoted such terms to you, it's clear that you have not fulfilled your MOP requirement.

Hi Syadiqin,

You have every right to request to sell in open market but that does not necessary mean HDB will approve to your request. Perhaps you may wish to get you Member of Parliament to assist you with your valid reasons should HDB reject your request?
