1) Can I sell a resale flat without fulfilling MOP? Given the flat was not subsided and no loan was taken.

2) Is it true that the years for the rented flat does not contribute to MOP?

Morning Steven,

All HDB buyers are required to fulfill their MOP prior marketing their unit in the open market. This is however not applicable if it's a divorce case or the owners have given up their citizenship or PR status. Some other marginal cases are based on prior approval.

Yes, the period where you have gotten approval from HDB to rent out your whole unit is not inclusive to the MOP.

Hi Steven,

For such cases, you'll require approval from HDB to sell, whether in open market or not. I have a client who sold their HDB in the open market although they have yet to fulfill their MOP. They too, have rented out their HDB as they are in Australia for most part of the year due to work commitments.
