Usage of Diplomatic Clause if tenant's spouse contract job ceased?

My tenant wants to move out of agreement using Diplomatic clause, citing spouse's contract employment cessation. Tenant is still employed in Singapore and spouse on dependant pass. Can tenant invoke Diplomatic clause?

The TA is in join name "TENANT Name & SPOUSE Name".
The Diplomatic clause -->
the Tenant/immediate occupant of the said premises, _TENANT NAME_ shall be transferred out of the Republic of Singapore permanently by his firm, ceased to be employed by his firm or if for any cause whatsoever shall be ordered to leave the Republic of Singapore, then and in such a case...

Hi Mr. Kumar,

You had read the contract very well.

Legally, yes, since TA is in both name, only if anyone of them were ordered to leave SG are able to use this clause to terminate the contract.

However, like you had highlighted, they were not ordered to leave but only one of them had lost their job.

So you might have to read it from the other angle on why they wished to terminate the contract. Can they still service the rent after one of them lost their job? Will they encountered situation where they could not pay you the rent if they continue the lease?

I would suggest you talk to them face to face to understand what was their main concern to terminate the lease rather than bringing this up to court. May be by reducing some rent would pull them through this difficult time and you gain a faithful tenant in long run.

Hi Kumar, if the lease is for 2 years and tenant have stayed for at least 1 year, then yes, they can apply for diplomatic clause in this case.

    The diplomatic clause is not written clearly. Both tenant or either of the tenant is transferred out of SG, etc...
