Is there a provision in your tenancy agreement that allows the tenant to terminate the lease prematurely? If there is, then you may also wish to look into the deposit refund covenant in the agreement. If there is no statement to allow the premature termination of lease, you are entitled to keep the deposit. If unsure, speak to the agent who brokered this transaction or a lawyer to advise your rights.
