I refer to the query in the url above and the Guru's response in relation to the ABSD. I'm in a similar boat, have already MOP-ed my HDB flat and looking to upgrade to an EC (getting a resale/ready. I am not keen to wait for TOP, so please don't ask me to consider buying from developer).
From the Guru's response, I note that I have to sell my flat before I exercise the OTP to buy the EC. I have looked at the IRAS website that the Guru has shared. From my reading on the IRAS link given, this is what they seemed to indicate in Section C(1) reproduced as follows: Similarly, the property is to be excluded from the count of properties owned by a buyer (A) if there is already a Contract or an Agreement to sell his property and the new buyer (B) has executed his option to buy the property.
My query is, if the buyers for my flat exercise their OTP before I exercise the OTP to buy the EC, am I right to say that I won't be subjected to ABSD?
I have read the other responses, e.g. involving the timeline, I should exercise caution in event that HDB may disapprove my buyers' intent, etc. So, I am just looking for the answer to my query above.
I am looking for some clarity before I proceed with my plan. This is because I want to maximise the chances of getting my preferred EC at the first instance (yay, go house hunting asap!) once I start to list my flat for sale and the buyers put in OTP.
