Hi there, I bought a 2-room BTO back in 2019, but currently residing at my brother's flat to help take care of my partially disabled, and elderly parents. I am in my mid-forties, and both my parents are in their mid-70s and 80s. Their health deteriorated in the short span of a year and caught us in an unprecedented situation. This has been going on for more than a year (from 2021 to present).

I am the sole owner/occupant and return to my flat several times a month to clean up the place, and get the much-needed rest from my full-time job and care-giving responsibilities.

I am waiting patiently for my flat to reach MOP, with the intent to sell it and purchase a bigger resale flat, so that I can have the space to hire a full-time helper and fetch my elderly parents to live with me (and my future wife) in the foreseeable future.

However, I am concerned about the 5-year MOP period being pushed back due to the reason I am not physically staying at my flat for 365 days. Since HDB rules imply that owners/occupants must physically occupy the flat for the MOP to be valid.

Should I be concerned about that? Is it possible to "surrender" the flat back to HDB? It's frustrating as I felt like being stuck in a situation where I can't sell off my flat, worried about not occupying it, while waiting for the 5-year MOP and worry about it getting pushed back.

Please advise.

PS. I appealed to HDB for a MOP waiver in 2022 but got rejected.

Hi,

It is indeed tougher to get a MOP waiver from recent observations, HDB seems to have tightened their criteria. However your case appears to have good reasons, have you tried to head to MP side to get their help on this? By the way, may I know your Date of Purchase so to know the exact 5 year MOP fulfillment date? I am contactable at 97432395  for further discussion.

HDB 4-room seller with early MOP appeal sale - Ms. Chng

We were looking for agents to help us with urgent appeal for early MOP and to sell off our flat. As it was 2 years before MOP, most agents who reached out were reluctant to assist much and unresponsive. I am sorry to hear about the situation. While you have tried appealing to HDB for MOP waiver earlier, may I know if you have submitted supporting documents for this waiver? Have you also seeked help from your MP in this appeal? While HDB has tightened the 5 years MOP policy, it does not indicate that you must be physically occupying the property for 5x 365 days in order to fulfill the MOP. It is a guideline to ensure that buyers who purchases a HDB are using the HDB as their primary home and not for investments purpose via renting out or just for its profits upon MOP.

I'd strongly encourage you to approach your MP for assistance or if required, visit Minister Lee's MPS directly for assistance.
