Hi. Im currently staying with my husband and sister under 1 roof because the flat is under me and my sister's name. But i have decided to sell the house because it has reached MOP next week but my sister refused to sell it. Its very frustrating for me.Can my husband still buy a resale flat on his own if i havent sell my current flat yet? Or do i have to sell the flat to do that? Or is there any other way for me to force take out my name from the current house im living in without involving her?

Hi Sasya,

I am sorry to hear about the situation you are in. It is unfortunately that your husband will not be eligible to purchase a HDB on his own, since both of you are married, therefore you must minimally be an essential occupier for the flat that your husband purchase if not a co-owner, and that means you must relinquish your ownership in the current flat with your sister. Since you sister is unwilling to sell the current place, will she be able to take on sole ownership of the property? Meaning you can sell your share to your sister so she can retain this flat while you are free to purchase another HDB with your husband.

Hi Sasya,

1) The main problem you are facing is your ownership of the current flat.
2) Since most of us utilized CPF to finance our property purchase, the minimum would be to return the funds utilized plus accrued interest in order to remove our ownership of the existing property.
3) You have to identify the main reason your sister refused to sell the current flat. Was it because she is not eligible to buy her own or she faced difficulties continuing to finance the flat without you?
4) If it is due to eligibility reasons, then you will have to wait till she reached 35 yrs old in order to be eligible.
5) If it is due to financial reasons, you have to discuss with her how this could be solved, such as you sell below value but enough to cover your funds utilized in your CPF.
6) There is no way to force remove your ownership without selling it out unless you have only used cash for this purchase and financed the mortgage. You may gift your share to her.
7) However do note that even by mode of transferring as a gift, she will still be subject to the gift stamp duty.

Hi Sasya,

Sorry to hear about the situation, I hope you are managing well. Unfortunately your husband cannot purchase a HDB under his sole name. Essentially the crux is to understand and address why your sister is not willing to sell the property, it could be due to financial reason as she cannot finance her flat on her own name and income or personal reasons. Would it be possible for your sister to move back in with your parents?
