Hi...
I am the owner of the hse..my hubby had passed away..My son is the occupier .if 1 day I passed away..can my son directly be the owner of the hse or he still got to go through the HDB to sell the hse ..
I had already make a will without his knowledge....40% he will get the share if the hse is sold away...the rest % I distributed to other organisations

Hi,

1) You should consult your queries with the lawyer who drafted your will.
2) You should have appointed an executor to execute your will. This should be stated in the will as well.
3) Your son can be the owner of the flat but he did not satisfy the eligibility conditions listed by the HDB. He will have to sell it in the market provided he is the executor of the will.
4) If a 3rd party is appointed as an executor. The executor will act according to the will within the law-permitted circumstances.
5) Once the flat is sold, the sales proceeds will be distributed according to the instructions in the will.
6) If your son satisfies the eligibility to keep the flat and does not want to sell the flat. There might be complications due to your will.
7) The organizations might bring this to court and force him to sell so that they could get their shares. This is when your son is not able to buy the shares from them, or they cannot agree on the price of the share.
8) Therefore, I strongly encourage you to consult your lawyer to ensure it is really what you intend to do after passing on.

Hi,

If the property is a HDB flat, he must be eligible to "own" the flat under one of the many HDB Eligibility Schemes, even if the flat is willed to him. If he's not eligible to own, he will still be required to dispose off the flat within 6 months upon the inheritance.

And you mentioned that he will only get 40%? This likely means he will have to sell off the flat, and distribute the proceeds in accordance to the Will. He will not be allowed to hold onto the flat.
