Yes, this arrangement is generally allowed under Singapore rules, provided it is done properly and reflects your actual living situation. Since you have already fulfilled the 5-year Minimum Occupation Period (MOP) for your HDB flat, you are permitted to move out of the flat. You may leave the HDB vacant or allow immediate family members, including your parents-in-law, to stay there rent-free. However, you cannot rent out the whole HDB flat or collect any form of rent from your parents-in-law without HDB approval.
From IRAS’ perspective, property tax is determined based on where you genuinely reside, not on ownership. If you and your husband truly live in the private condominium as your main place of residence, the condo may be taxed at the owner-occupier property tax rate, while the HDB flat will be taxed at the non-owner-occupier rate. This is acceptable as long as the declaration made to IRAS is accurate and reflects the actual living arrangement.
It is important to note that IRAS may assess factors such as your registered NRIC address, utility usage, and where your official correspondence is sent to determine your true place of residence. If the condo is declared as owner-occupied but you continue to primarily live in the HDB, this would be considered a false declaration and may result in backdated taxes, penalties, or fines.
In summary, you may move to the private condo and have it taxed at the owner-occupier rate, while your HDB is taxed at the non-owner-occupier rate, as long as you genuinely reside in the condo and comply with both HDB and IRAS requirements.
