Hi .. I am staying at a condo paying $2550 for a studio.I have been paying my rent promptly and it is a co living . Just a couple of days ago when I still have almost 2 months to complete contract the company calls and asks me to vacate the unit in a couple of weeks and then after a lot of negotiation they said they will offer a common or a master room in another location as it’s their fault and but they say their company policy is that I need to again sign a new contract which is for 3 months minimum. I was not willing to agree. I also told them the contract is very clear and transparent saying if the tenant because early before 12 months you will forefeet the deposit but here it’s the company who is asking me to vacate since they say their land lord is not agreeing to renew the master contract. I told them that’s your internal I can only as a tenant follow the contract provided to me and I follow it they Sait it’s their company mistake and oversight etc etc.
At this junction what can I do and if the company is not following the contract what can I do or where can I complain? Need your advice.

You need to engage a lawyer to work on this case if you wish to get anything out of the situation. Otherwise the only way forward is either accept their proposal or look for alternative place on your own.

Did you have an agent supporting you when you first signed the contract? That would be the first person you might go to for support and mediation with the landlord. If you opted to sign directly with the company without engaging the help of an professional agent on your side, you might have to resolve the issue on your own.

For the amount of rent you are paying, you may not find it worthwhile to engage a lawyer. Nevertheless, you do have that option to seek justice against the co-living company if you feel they have have wronged you.

If you were a client of mine and I were representing you as your tenant agent, I would personally not take 'company policy' as a valid excuse from the co-living company. But you have to weigh your options.

Perhaps seek for a better room from the co-living company at a discounted rent over the 3-month period. Or you can start looking for an alternative place immediately and see if the co-living company will pay you out for the remainder term of your current lease.

you can drop me a whatsapp, personal opinion : its not worth or practical engaging a lawyer to pay $2-7k to get back few K deposit , my opinion : get back yr security deposit as soon as possible and faster move out to anew place then pay $10 to small courts tribunal to claim compensation such as " inconvenience cost of moving " etc , but get back the security deposit as soon as possible since it is in the operator hands,..

Hi,

1) There is always a laspe between the lease agreement signed by the coliving company & the owner, because it takes time to find a tenant and the a later shift-in date.
2) They are breaching the contract by asking you to move out. Thus, you are on the upperhand.
3) You can negotiate to have more benefit such as monetary compensation, longer lease period at a lower rent, etc.
4) The signing of a fresh tenancy agreement is legal, as this is required by the URA, i.e. law and policy.
5) Although, this should be advised by a lawyer. But, note that if this is going to be handle by a lawyer, the cost that would incurred will not be low.
6) If this is going to be bring up to court, you will be expecting to pay at least $10k to begin with.
7) So, you cannot push all the way. As they might have no choice but to deal this by law.
