Hi, I am 21 years old, single and no siblings. My dad passed on and I inherited HDB as sole owner. I would like to sell and repurchase a smaller flat (downsize) according to my dad s wishes under single schemes, orphan scheme if possible. However, my mom (MALAYSIAN CITIZEN) is divorced and estranged, so I do not fulfil the criteria of an orphan. How do I appeal to HDB?

Since you don’t meet the standard orphan scheme criteria, HDB usually treats your case under the normal single or succession rules. You can still sell and buy under the single scheme, but HDB’s approval will depend on your eligibility, remaining lease, and other criteria.

For cases like yours, it’s best to submit a formal appeal or request for special consideration directly to HDB, explaining your situation clearly—mentioning your dad’s wishes, your sole ownership, and your mother’s citizenship/estrangement. Attach supporting documents like death certificate, ownership papers, and any legal documents regarding your mother’s status if needed. HDB can review on a case-by-case basis.

Hi,

1) I'm regret to hear your situation. There is no quick solution to solve your immediate problem.
2) As you are not classified as an orphan because there is no evidence to show both your parents passed.
3) Under the current policy, a single citizen can only own an HDB flat by reaching 35 years and older.
4) You have to find another single to help you to be eligible to keep the flat even though this was solely left by your dad.
5) The single can be non-related citizen, non-married or divorced, 21 years and older, or your future spouse (must produce marriage within 3 months after purchase).
6) At the meanwhile, try to appeal to HDB to either give longer grace period, otherwise would be to sell within 6 months, or give exception case for you to live alone there.
7) You might need to approach your MP for a stronger endorsement if the initial appeal fail.

Hi,
I would suggest you keep the flat if you are able to because, if you sell that flat, you may not be able to buy another flat, as you are a single. Try applying for HFE first, and see what you get. Your application might be rejected. So, do not rush into selling first.
