Hi Su Ann,

Unfortunately no, as you have to do the necessary arrangements to lodge a notice of death with SLA about the co-owner's demise, and also for the executor or administrator to transfer the ownership according to the Will. Once that is legally completed, the property can be rented out by the owner that inherited the property and any other co-owners.

When the sole owner of a property has died, the property is normally distributed according to:
- the person's will if there is a will left behind
- the Intestate Succession Act if there is no will left behind

If the person left a will, you will have to apply for a Grant of Probate before you can manage the deceased's property.
If the person did not leave a will, you will have to apply for Letters of Administration before you can manage the deceased's property.

Sorry to hear about your loss. May I know who is the legal owner then with the passing your your husband? Is there any will? Given that the condo is your in your name, you are ineligible to rent out the property and to do so, you will need to have the property transferred under your name in order to do so, the key consideration is if your late husband has left a will, otherwise his estate will be passed down based on the intestate succession act.

Unfortunately, you are not able to rent out the property while it's under your Husband's estate. Upon the demise of the owner, the Will (if any) will be executed. Should there be no Will, the estate will be divided accordingly based on Singapore Intestate Law.
