Hi all, We had finished our rental contract on Apr 2014. However, the owner keeps delays the returning of deposit till now. We contacted our agent and co-broke agent, they just told us to directly contact owner. Seems like after contract over, the agent are no longer take any responsibility for our deposit. For the deposit, we (owner and tenants) did agree that small amount (not full deposit) was deducted due to some services need to take place. The question is, what we can do to take back our deposit as owner keeps delaying and the agents are totally not help us in any ways. Thank you.

In most cases, your agent who represented you only have contact with the cobroke agent and not the landlord. Lets give him the benefit that he did try to help but it stopped at the cobroke agent level. You may also have a dishonest landlord. I suggest you give your agent a call again, have him relate the message to the landlord (thru cobroke agent) that landlord has XXX months to return the remaining deposit, as stipulated in the tenancy agreement. After that time frame, if you still do not get any reply or your money back, you can report to police. Like one agent pointed out, the duty of your agent ends with the contract. Sometimes, there is little he can do to help. There are many agents who, for many reasons, able to get to the landlord or cobroke and expedite the return of deposit.
