Hi all,
need a bit of advise.
I have subletted my flat to two occupants who are expats, John and Tom for a year, from May 2010 to May 2011.
The tenancy agreement is between myself & John's employer. Recently, I've been informed by John that he will be posted to Korea for a few years and therefore he and his employer will not be able to fulfill the tenancy agreement.
However, as Tom is the other occupant, John would like Tom to "take over" the remaining terms of the tenancy agreement, ie, change the name of the tenant in the agreement to Tom instead of John's employer.
Is this considered a break in tenancy agreement?
Isn't changing the name of tenant the same as drawing up a new tenancy agreement?
Is this legally allowed, ie, will HDB allow this?
What should I do?
