Yes, tenant should be responsible in maintaining the aircon since they are using it. Or you may cover the aircon maintenance charges and include them in your rental rate charged to the tenants. All tenancy agreements are considered private agreements between landlord and tenant therefore it is not a fixed requirement for tenant to be responsible for the maintenance of aircon even for those which are not brand new.

The key is to reach amicable conditions where both landlord and tenant can agree to and move on to closing the transaction where both parties are happy.
