Dear Mr Guru

We rented our condo for more than a month and tenant still come back to complain the lighting is spoilt.

Can someone advise me whether we should take the responsibility or the tenant should get his own maintenance fixed as the contract has stated that after a month, any wear and tear should be borne by tenant?

Hi, most of the Tenancy Agreement will state that tenant will bear $200 of the repair cost per item and the rest will be borne by landlord. You may also refer back to your agent who assisted you in the first place.

Dear Eric,

If it has been a persistent issue since the tenant moved into the unit, I believe you should look into it as you have not fully rectified the problem. I had this episode of recurring light issues for 1 tenant which I was representing and landlord has managed to finally resolve the issue after a couple of months. It would be good to have a proper diagnosis of the issue before conclusion on this issue.

when you said tenant "STILL" come back to complain. Does it mean tenant has complained about it before during the first month ?

Or did you mean they complained After the first month ?

I recently rented a unit to an expat family. They did not move it as their shipment did not arrive until a month after the lease has started.

Anyway, 2 months after the lease started, they complained that the dishwasher wasn't working, 1 of the toilet flush didn't work.

as it was a big unit of 3600 sqft and 5 rooms, it took the tenants (2 adults and 3 infants) some time before they started to use every equipment and rooms.

The landlord repaired everything. though it was already going into the 3rd mth.

If you are certain that it was handed over at "perfect condition" and there was no complain in the first month but they came back after that, then tenants should bear the cost as stated in the TA. Read More

Dear Eric,

Yes. The minor maintenance clause is applicable after one month from date of handing over of the premises.

Having said that, you may wish to ascertain the cause of the failure of the lighting. If changing the bulb solve the problem, then tenant should do it at their own cost. However, failure could be due to faulty light holder, transformer, etc.... and this could be the responsibility of the landlord depending on the terms and conditions of the Tenancy Agreement.

You may speak to your agent for further clarifications.
