I purchased my EC when I was single as the owner and my mother's as the occupant. I am married now and the EC has reached its MOP.

My wife is a Singapore PR and she is not too pleased that the EC does not have her name. She is hinting to remove my mother's name and replace her name as the occupant.

In Summary :
1) EC pass MOP
2) Single owner in my name
3) Current occupant is my mothers name
4) Wife (married after purchase of EC) wants her name to replace my mums name as occupant

May I know what I should do? I am confused as
1) the EC is already 5 years do we still need to contact HDB?
2) or since the EC is over 5 years do we approach the lawyer to add my wife as the occupant
3) what are the implications?

I hope the gurus and experts here can help me with my questions.

Dear Owner,
Since the EC is more than 5 years old, there is no need to include occupant's name. Legally, this is a private unit. So, you the single owner and there is nothing else to do. If this is HDB, you can include your wife's name as occupant but this is not. The inclusion of your mum's name for EC is only valid at the application stage and the subsequent MOP period. Only the legal ownership is recognised now by the law. So, mum and wife are on level standing.

    Dear Owner,
    Without the occupier, there would not be a family nucleus for you to apply for a EC. So, for the 5 year MOP period, it was a legal requirement. Once it is 5 years old, the EC is considered a private apartment with a single owner. For private apartments, there is no occupier requirement.

As you have already met the MOP of your EC, it is now considered a private property. There is no occupiers or essential occupiers involved for private properties. You do not have to worry about anything as there is "nothing to add".

Hi,

1) Your EC already passed MOP, thus it is classified as a private residence to SC and SPR.
2) In a private residence, there is no necessity under the law to add any occupier as occupants.
3) By adding your wife as occupant does not imply she has a share in the property, and there is no way of doing so as well. Only that the occupier has to update his/her address to ICA under the National Registry Act.
4) It is only if you do a part-sale to her to make her a co-owner that will benefit her when the EC is appreciated in the future.
5) You will need a lawyer to do the paperwork for part-sale, and there is buyer stamp duty involved. Since she is an SPR, she is also subject to ABSD. She can apply for a mortgage loan if needed.
6) If you intend to include her as co-owner, there are 2 types of holding methods for a property when multiple names are owning it.
(a) Joint-Tenancy: each will own an equal share. The survivor will take all policies applied. None of the owners can set up a will to will it to anyone.
(b) Tenancy-In-Common: Each party can decide how many shares to own in the property. Each can will his/her share of the property to anyone.
