As a tenant, after serving the notice as per diplomatic clause, am I liable to pay the landlord agent the prorated commission? He is going to find another tenant soon and will get double commission for the same time.

Hi Mrs Geeta, Look into your existing tenancy agreement on the clause of premature termination. It should be stated within the agreement. The notice period is actually to allow landlord to start working on securing a new tenant, therefore in usual tenancy agreement, the tenant should pay whatever amount of service fees charged by the salesperson which has not been consumed (pro rated) to the landlord, but not the salesperson, since landlord has already paid for the services of the salesperson to secure your tenancy, and this premature termination is at no fault of the salesperson, therefore there should be no refund of the services fees by the salesperson back to landlord. Hi, it may appear to you that the agent is earning double commission over this period of time, but do bear in mind the agent have also double his time cost and also effort to secure another tenant for the owner. By exercising your diplomatic exit rights as granted by the owner, the agent also have to provide service to coordinate the handing over the unit, inspection of the unit and also arrange the refund of your deposit withheld by the landlord back to you.     Thanks a lot for your quick response. We paid the agent, but I still think it is unfair on the tenant. We are not involved in that transaction and so we should not be paying that amount. We are paying rent for the stipulated notice period. as per the clause and yet the owner is charging us for what? are we able to take the agent commission back from our agent? The cost and effort you are talking about will be paid to the agent when he gets a tenant, We left the house end of Apr. We were charged pro-rated commission till November. Are you telling me the house will be empty till November? the clause is designed to hit the tenants. I am sorry but the document is pro-Landlord. Unfortunately, this is the only unhappy experience I have had in Singapore
