My son & daughter-in-law are working overseas.
They had rented out their 4-room for the last 5 years.
Now HDB does not allow them to extend to rent out anymore.
They do not have MOP because of this.
My son wants to let me & wife to stay in his flat for free.
So I plan to sell my 4-room flat to stay in his house.
If so, will he qualify for MOP after he lets us stay in his flat?

Hi,

He has to be occupying the property physically for fulfilling MOP purposes. As the name MOP suggests, it is the minimum occupation period, and it will be 5 years of him staying physically before he can sell or rent out or purchase another property. I am guessing the past subletting approvals were special approvals given for overseas posting cases? In that case, the MOP counting is suspended and will not count towards fulfilling MOP.

I would like to compliment Mr Ivan Ng for his professional work and effort.I sent my first post in Jan 2019 and Ivan replied promptly, so I have decided to contact Ivan for follow up. My EC was not ready for sale due to MOP (another 3 months from Jan) at that time and Ivan was able to give me advices on how to proceed from there. Initially we have decided to try to write to HDB for early sale but since it was only 3 months left, eventually we waited for another 3 months while we looked for our next property. Hi,

1) Your son had received special approval from the HDB to sublet the flat out for the past 5 yrs.
2) Since an HDB flat is meant for citizens and residents who really need accommodation for their own use and not for profiting purposes. Therefore the HDB will cease the special approval after much consideration.
3) The MOP only counts when the owners of the HDB flat stay in the unit. Therefore for you to shift in will not start the MOP counter.
4) Thus you must have a full understanding of the implication by shifting into his flat after selling yours.

Maybe you can speak to the HDB branch office to see the viability of adding yours and wife's name into his flat or other ways so the duration can be contributed to the MOP being fulfilled.
