My property owned by my husband and I (Joint tenancy), my husband just passed away, and the housing loan(bank) fully repaid already. now I am planning to redeem, discharge of the morgage, and hiring a lawyer. Just a question, in order to redeem, I must change the ownership of the property from 2 names to 1 name. I asked SLA, how to change the ownwership I must get the cert of title. changing ownership first, or redeem the title deed comes first? I am confused. BTW this lawyer asked me to pay $700 just to change the ownership from 2 names to 1 name. I thought join tenancy automatically change the ownership to the surviving owner.

By the way, I believe you are referring to private property and yes in most cases, the surviving party will just need to submit the death certificate of the other spouse to the law firm and the lawyer will handle everything.
