Is the 3 months extension stay the only option? Anyway to meet in the middle for the extension? I believe that listening out to the buyer and working together to find common ground will be important, but if you are saying that buyer is refusing to meet or call to discuss, this can be very tricky. Your appointed agent should look into this and rectify the situation given that it was agreed before, I am unsure why this was not reflected in the resale application. Read More

    Sorry to hear about the predicament. HDB will not involve themselves in such disputes, thus if the buyer's decide to unilaterally back out of the agreed terms and want to take possession of the property after completion, you may wish to get the legal advise from the lawyer directly. To evict you out of the property may not be that simple as you have proper records about the agreement, but since you mention that you have children with you, any trauma that comes along with these lingering issues may not be healthy for them.

    I strongly encourage you to try further to engage with buyers on this matter and settle it amicably, although I am aware that you have mentioned, buyers are refusing to meet or discuss further.

    This is reflected in sale application. We both applied thru HDB and approved. But now 2 weeks from completion she inform us to cancel the extension thus we are extremely stressed with 4 kids at such short notice.

    Thank you for your insights ABLE. I have called the HDB conveyancing lawyer to mediate but still buyer insist not to meet. Although we applied extension thru HDB and approved, she may just go in and cancel the extension at day 1 with her singpass and there is nothing we can do
Hi Paul,

If there are proof that the buyer has agreed on the extension of stay during the negotiation process, you may use that as a proof to hold the buyer to his or her words. As the owner, if the buyer side does not honor the initial agreement, you have the right not to complete the sale as well.

For such cases, I would encourage that you arrange a face to face meet up with the buyer and iron out the issue. This is the best option as sometimes face to face discussion is easier to achieve an outcome.
