Hi Ken, the actual counting of 4 years started on the date where you exercised the S & P at the law firm.

You might want to check when did you exercise your sale and purchase agreement in the past. Just count 4 years on from that date, you will avoid the seller's stamp duty.

If you want to double confirm on the date, you might want to ring up the law firm that assisted you with the purchase.

Hi Ken,

The applicable Seller's Stamp Duty period is 4years from the date you exercised the Option To Purchase / Sales and Purchase Agreement with your seller to the date which your buyer exercises the Option To Purchase. Even a day before it expires you will still be subjected to the stamp duty. I have assisted a client to sell off his property with considerations of Seller's Stamp Duty 6months away to avoid the stamp duty.
