Hi, for your case, it is advisable to sell first then do the purchase next. Once buyer is found and upon exercising for your unit at the buyer’s law firm, then you could go on to pay for the option fee for your next purchase. It would be perfect if the next purchase unit is vacant and the owner allow early move in by signing an indemnity. That way, you do not need to have an interim housing. Good afternoon,

Based on the limited info shared, and based on prevailing regulations, assuming you only own one residential property at the moment under your name, once the OTP of your current property is exercised, you will be considered to no longer have any property count and can go on to purchase the next property without ABSD. Definitely there are risks involved.

Would you also need the sales proceeds of the current property to come back first before you can complete the purchase? All these queries can be addressed if I can have more information to tailor the most optimal approach that meets your objectives.

Speaking from experience as an owner, it's a better option to sell first then buy. Since your current is a private property, you can always sell and rent back for a short period which will not cause too much tension when your next home's renovation got delayed.

Dear Sir/Mdm,

1) For the selling, once a buyer is secured and the price is agreed upon, an option to purchase will be issued with the buyer passing you a 1% cheque. The buyer has to exercise the option within the option period usually 2 weeks. Once the option is exercised, the sale is considered done and the completion of the property is about 10 weeks away.Completion is the day when you receive your sales proceed and you hand over the unit.

2) If the buyer did not exercise the option within the option period, the sale will be void and you may forfeit the 1% deposit that is placed by the buyer. In this case, the whole process of sourcing for a buyer will start again.

3) To avoid the ABSD, after the buyer of your unit exercised the option, your property count will be regarded as "0" and you may proceed to purchase another unit without the need to pay ABSD.

4) A Sales and Purchase document is used when you purchase a new launch project. The option period is usually 3 weeks.

Hi,

The procedures of purchasing a resale private property versus a new launch differs slightly. But generally, you will be able to loan up to max of 75% of the purchase price (or valuation price, whichever is lower). This means that you will have to put up a initial downpayment of up to 5% (usually 1% option + 4% exercise for resale), and balance 20% upon the completion date of the purchase.

If the OTP period lapses before Buyer could exercise the OTP, the option monies will be forfeited by the Seller.

If you're looking to sell and buy a property without incurring ABSD, you should wait for the Buyer of your current property to exercise the OTP before you exercise the OTP for your purchase. If you're looking to utilize the CPF refunds from the sale of your current property, it is best if you could set a time buffer (usually 3 weeks) for the CPF funds to be returned and ready for your purchase.

An S&P agreement is an agreement between the Buyer and the Developer (for a new launch), whereby the Buyer will proceed to exercise the agreement at the lawyer's office within 8 weeks upon OTP issuance.
